Welcome to Bx, a global software-as-a-service product for small businesses.

The below information explains our stance on privacy, security and also sets out our terms of use.

Privacy Policy

At Bx we take your privacy seriously. We will never sell, reproduce or distribute your personal or business specific information. Personal or business specific information is any information that can be directly linked to a particular individual or business. Your personal and business specific information is used solely for the provision of Bx's services to you and/or any agents or services you authorise to use Bx's services on your behalf. Bx may generate anonymous, aggregate data on users for the purposes of service management and research.

Security

All communication within the Bx app is secured via bank-grade encryption (SSL/TLS), and your data is stored securely on servers within data centres with strict, restricted physical access rules.

Terms of Use

These Terms of Use explain Bx's obligations as a service provider and your obligations as a user.
IT IS IMPORTANT THAT YOU READ ALL THE TERMS AND CONDITIONS CAREFULLY.

If you use our service, you agree to be bound by these Terms of Use without any modification, adjustment or qualification.
IF YOU ARE DISSATISFIED WITH THE TERMS OF USE, YOUR SOLE RECOURSE IS TO DISCONTINUE USING THE SERVICE.

If you are unable to meet all the conditions stipulated in these Terms of Use, or if you breach any of the Terms of Use, your permission to use Bx is automatically and immediately revoked, and we reserve the right to delete your account and remove your data from our servers. Bx allocates to you a non-exclusive, non-transferable limited license to use Bx and any related resources. You agree not to infringe upon our intellectual property and/or the intellectual property of any of our partners. Moreover, you will comply with the terms of any applicable license agreements. You agree that any communications that we may deliver or communicate to you from time to time comply with the terms of any applicable electronic documents legislation, including the requirement that such documents be in writing, are capable of being retrieved, reviewed, printed and stored for further use by you.

You agree to use Bx's services for the purposes that they were intended and only in accordance with the terms of this agreement.

Bx is not responsible for your data, and you are fully responsible for the content and integrity of the information you input into our services or software. Bx owns the proprietary rights as well as the intellectual property rights to all URLs, materials, products, web content, designs, layouts, images, text, tools, utilities and software that make up the Bx services, excluding your data. Technical procedures, processes, concepts and methods of operation that are deployed within Bx constitute trade secrets. The usage of our Services does not constitute a sale or transfer of intellectual property rights to the users whatsoever. Any information or data entered while using Bx by a user or on the user's behalf shall at all times remain the property of the user. The user hereby grants to Bx a global, perpetual, royalty free, nonexclusive right and license to use and host all content provided by the user with respect to Bx's services.

Any materials or software downloaded from Bx, are protected by copyright, trade secret and other intellectual property laws. Subject to your ownership of your user content and data, Bx reserves all rights in and to such materials. You will not store, download, transfer, sell, reproduce, redistribute, modify, reverse engineer or copy the services or any of the materials or software that form part of Bx's Services.

You are responsible for any lost or unrecoverable Content. Bx is not responsible for the Content or data you submit through the Services. You agree not to use, nor permit any third party to use, the Services to upload, post, distribute, link to, publish, reproduce, engage in or transmit any of the following, including but not limited to:

Illegal, fraudulent, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind;

Content that would impersonate someone else or falsely represent your identity or qualifications, or that constitutes a breach of any individual's privacy;

Any content that could be interpreted as spam;

Viruses, malware or other disruptive or harmful software or data;

Any information, software or content which is not legally yours and that you are prohibited from sharing with Bx.

YOUR USE OF THE SERVICES, SOFTWARE, AND CONTENT IS ENTIRELY AT YOUR OWN RISK. THE SERVICES ARE PROVIDED 'AS IS'. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BX, DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY THAT THE SERVICES ARE FIT FOR A PARTICULAR PURPOSE, MERCHANTABILITY, DATA LOSS, NON-INTERFERENCE WITH OR NON-INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS, OR THE ACCURACY, RELIABILITY, QUALITY OF CONTENT IN OR LINKED TO THE SERVICES. BX DOES NOT WARRANT THAT THE SERVICES ARE SECURE OR FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, THEFT OR DESTRUCTION. BX DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES THAT YOUR USE OF THE SERVICES WILL ENSURE COMPLIANCE WITH ANY LEGAL OBLIGATIONS, LAWS OR REGULATIONS. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USE OF THE SERVICES IS IN ACCORDANCE WITH APPLICABLE LAW. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ENTIRE LIABILITY OF BX FOR ALL CLAIMS RELATING TO THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES DURING THE ONE (1) MONTH PRIOR TO SUCH CLAIM. SUBJECT TO APPLICABLE LAW, BX IS NOT LIABLE FOR ANY OF THE FOLLOWING: (A) INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES; (B) DAMAGES RELATING TO FAILURES OF TELECOMMUNICATIONS, THE INTERNET, ELECTRONIC COMMUNICATIONS, CORRUPTION, SECURITY, LOSS OR THEFT OF DATA, VIRUSES, SPYWARE, LOSS OF BUSINESS, REVENUE, PROFITS OR INVESTMENT, OR USE OF SOFTWARE OR HARDWARE THAT DOES NOT MEET BX SYSTEMS REQUIREMENTS.
